The Americans for Prosperity (AFP) has filed a lawsuit against the Biden administration, alleging that it is imposing unnecessary regulations on the use of artificial intelligence (AI), thereby expanding executive authority in an unprecedented manner.

According to an article from the AFP, Foundation Investigative Analyst Thomas Kimbrell stated, "The Biden administration’s decision to invoke the Defense Production Act to regulate artificial intelligence is a troubling imposition of regulatory overreach. The DPA is intended to provide for national defense during times of war or national emergency. Emergency powers are meant to be temporary, but it is unclear what the administration’s end game is here. AFP Foundation is seeking transparency from the administration on its authority and intentions to use the DPA in such a novel way."

In another article from AFP, it was suggested that this case represents yet another instance of a president improperly exercising emergency powers to bypass Congress in order to implement policies they deem appropriate. The lawsuit includes a Freedom of Information Act (FOIA) request aimed at enhancing transparency around Biden's Emergency Powers Reform Project. This legal action seeks to better inform both the public and lawmakers about how Biden is allegedly misusing his authority with respect to deploying emergency powers.

According to an article from The White House, President Biden issued an executive order aimed at ensuring safety and security amid AI development. The order requires that safety test results and other pertinent information be shared with the government as AI continues its rapid evolution. This executive directive intends to protect American privacy, advance equity and civil rights, support workers, promote innovation and competition, and bolster American leadership globally. The White House asserts that the administration will persist in developing an international framework for governing advances and applications of AI. This executive order builds upon previous actions taken by President Biden.
